Construction Repair

Painter stains carpet. Owner wants carpet replaced. Painter agrees to pay from balance owed painter. Owner hires carpet company of own choice. Carpet company does repair. Owner pays both painter and carpet company before inspecting carpet repair. Owner inspects repair a week later. Owner not satisfied with repair. Owner expects painter to pay for another repair because carpet company states painter instructed them how to make repair. Painter and carpet company did discuss cost and method of repair. Is painter liable for repair. Essentially — The painter only owes for 1 repair. If the property owner is not satisfied with the quality of the repair- that’s an issue between the property owner and the carpet company. The property owner chose the carpet repair company. The painter has met his obligation. The painter is not liable for any additional repair.

    Owner is at fault, It is owner's responsibility to inspect work before paying for it. Owner might be able to convince carpet company to return and fix problem. Painter has no responsibility at this point
